Professional Negligence

Even the professionals get it wrong sometimes and make mistakes. Understandably, their clients expect to be compensated for their losses and most professionals will have insurance to cover such claims.   However, negligence claims are not always clear cut because there are rules as to:

  • who can make a claim;
  • the amount of compensation; and
  • proving “negligence”.  You have to prove that there has been a breach of the duty owed to you in relation to the service provided and that the advice was incorrect or involved errors resulting in you suffering a financial loss.
