Draft Smoke and Carbon Monoxide Alarm Regulations

The Smoke and Carbon Monoxide Alarm (England) Regulations 2015 contain the draft proposals which are expected to come into force on the 1 October 2015. They will require residential landlords in the private rented sector to

  • Ensure a smoke alarm is installed on each storey of the premises which are being used partly or wholly as living accommodation.
  • Ensure a carbon monoxide alarm is installed in any room that is being used wholly or partly as living accommodation and contains a solid fuel burning combustion appliance.
  • Ensure that smoke and carbon monoxide alarms are in working order at the beginning of any new tenancy.
    The purpose of the regulations is to reduce the number of injuries or deaths from smoke or carbon monoxide poisoning in the private rented sector.

However, the regulations exclude Houses in Multiple Occupation as they are already covered by other legislation and specific guidance already exists to assist landlords to determine the appropriate standard of fire detection and alarm.
