Separation Agreements

Separation agreements are for separating couples where divorce or dissolution of a civil partnership is not desired or appropriate and can deal with all issues relating to separation, including financial issues. For a separation agreement, there is no need to show that a marriage or civil partnership has broken down irretrievably, unlike in a divorce.

Separation agreements are beneficial for both parties as they will normally stop one of the parties from subsequently changing their minds about an agreement that has been reached. It, therefore, safeguards your position because if one of you later refuses to abide by the terms of the agreement you can take the agreement to a Court and request the Court to enforce the terms, as effectively the other party has ‘breached the contract’ between you.
